REGULAR MEETING-MONDAY, JUNE 12, 2006-7:00 PM-MUNICIPAL BUILDING

The Regular meeting of the City of Buffalo City Common Council was called to order by Mayor William Bruegger. Roll call: Kassel, Seitz, Wicka. Excused: Anderson. Also present: City Superintendent Baker, Matt Ward, Don King, Rob Dascher, Dave Becker. The meeting was held as noticed.

Motion Kassel, second Wicka to accept the minutes from the May 8, 2006 Regular meeting. All yes, motion carried.

Citizens: Rob Dascher inquired about the status of the outdoor furnace ordinance. Kassel has met with the City Attorney who is recommending that regulation of outdoor furnaces be added as an amendment to the zoning ordinance, and that if a property owner wanted to install an "outdoor heating appliance" they would have to apply for a conditional use permit which is granted by the Board of Appeals. The Mayor asked the Health & Safety Committee to come up with guidelines for this. A property owner voiced his concern about lack of vision on the corner or 19th & Schiller due to the way vehicles are parked on the corner property. There is a City ordinance regulating Vision Clearance. The offending property owner will be sent a letter asking him to move his vehicles so traffic vision is unobstructed. Another property owner stated that he doesn’t feel that a neighbor is compliant with removing a fence. Wicka stated that he has talked to the property owner, and the owner is waiting for dirt to fill in the postholes. Dave Becker voiced some concerns regarding community support of the landfill/recycling center. Matt Ward asked about a sign on River Road for his new business (Ward’s Riverside Cabins). He was told to talk to the County Highway department, or maybe the Corps of Engineers. He also asked about the existence of the alley between 19th & 20th streets.

Health & Safety: Council members Kassel and Seitz, and the property owner who received a citation for violation of the Property Maintenance Ordinance met with the City Attorney to discuss progress on clean-up of the property. The property will be checked every 30 days; it is still not compliant with the Ordinance. A property owner at 9th & Humboldt is also in violation and will be sent a letter and copy of the Ordinance. Motion Seitz, second Kassel to advertise for the Animal Control position. All yes, motion carried. Applicants must be 18 years old, hours vary, $8.50/hr. The Mayor and Clerk will work on the ad.

Recreation: Wicka announced that due to some personnel issues, the Committee will try to have more control over Little League activities starting next year.

Cemetery: Seitz is concerned about the financial responsibility to maintain the Trust to Beautify Graves for as long as the Cemetery is in existence. A committee meeting will be scheduled.

Riverfront: the Clerk will try to set up a meeting with the Corps and the Riverfront Committee. Wicka would like to investigate the possibility of putting in some public boat docks-day use only. This will be brought up at the meeting with the Corps.

Mayor’s update: the Wednesday Quilter’s group has presented the City with a quilted wall hanging depicting scenery of the area. This gift is in appreciation for letting the group meet regularly in the Community Room. The wall hanging will be displayed in the Community Room. The 4th of July parade will be held on Saturday, July 1st in Cochrane. Any Council members wishing to ride on the fire truck should meet at the City Building at noon the day of the parade.

City Superintendent: 30 stop signs & posts have arrived. Cory is working with Riverland for placement to avoid existing wires. Fourteen applications were received for the City Employee position; the Superintendent and Clerk narrowed this down to six candidates who were interviewed. The Council will interview two candidates on Wednesday, June 14, 2006 beginning at 5:30 pm.

Clerk/Treasurer: Motion Seitz, second Kassel to grant a Class A Liquor/Beer license to Robert & Julie Hermann, Buffalo City Food Mart; and Sandra D. Michaels, B&S Express. All yes, motion carried. Motion Wicka, second Kassel to grant a Class B Liquor/Beer license to MC Richardsion, Inc., Cecilia Kaiser, Pres., Buffalo City Resort. All yes, motion carried. Motion Kassel, second Seitz to grant a Cigarette & Tobacco license to Cecilia Kaiser, Buffalo City Resort; and Sandra Michaels, B&S Express. All yes, motion carried. Motion Kassel, second Seitz to grant a Non-Intoxicating Beverage (Soda water) license to Robert & Julie Hermann, Buffalo City Food Mart; and Sandra D. Michaels, B&S Express. All yes, motion carried. Motion Seitz, second Kassel to grant Beverage Operators licenses which must be paid for before being issued to: Linda Ameible, Angie Marie Anderson, Sandra Becker, Rebecca L. Bright, Stephanie Bruegger, Ruth Eppler, Tammy Huntley, Brandy Lynn Kaiser, Karla K. Klopp, Brady Michaels, Kirie Phillips-Saxon, Bonnie L Rieck, Tammy Sanborn, Janel Schmidt, Brenda Sobotta, Jennifer Steinbach, Matha Tuite, Nicole Wicka. Wicka abstaining, all yes, motion carried. The Council agreed that Paradise Bay would be responsible for all costs if a Special meeting were held to approve their license applications. The Mayor read a petition he received concerning Paradise Bay noise, garbage, and odor. 2006 Open Book will be on Wednesday, June 21 from 1:00-3:00 pm, with Board of Review to follow from 4:00-6:00 pm. Due to a clerk conflict, the July meeting will be held on Wednesday, July 5 at 7:00 pm. Kassel and the Clerk will work on a proposal for City banners as requested by Ye Old Shoppe.

Other business: Seitz asked about City finances and investments. The Finance Committee will review CD investment practices.
